Terms and conditions of the prize game “Win Ball Back System” by Ball Back System d.o.o.

1. General provisions
These rules determine the manner of conducting the prize game “Win Ball Back System” (hereinafter: the prize game). The organizer of the prize game is Ball Back System, Rabelčja vas 43, 2250 Ptuj (hereinafter the organizer). VAT ID: 79855067.

The rules of the prize game are published on the website https://www.bbs-tennis.com/.

With these rules and conditions, the organizer determines the rights, obligations, and conditions for participation in the prize game. All participants are considered to have agreed to be bound by these terms and conditions by participating in this prize draw.

The prize draw takes place only on:

2. Purpose, place, and duration of the prize game
The purpose of the prize game is to promote Ball Back System. Advertising and participation in the prize game are carried out by the regulations on advertising products issued by the organizer of the prize game on the Slovenian market. The prize draw is held in the territory of the Republic of Slovenia.

The prize draw lasts from 2 December 2021 to 5 December 2021 until 23.59 inclusive.

3. Terms of participation
Citizens of the Republic of Slovenia, residents of the Republic of Slovenia who are over 18 years of age can participate in the prize draw. If the winner is under the age of 18, he/she must be represented by a person over the age of 18 who, by law and/or by appropriate authorization, has the right to represent the said minor (hereinafter referred to as the participants).

Employees of Ball Back System d.o.o., or their immediate family members (including extramarital partners) are not allowed to participate in the prize draw.

The condition for participation in the prize game is that the participant follows the Instagram / Facebook / TikTok profile of Ball Back System, submits a comment under the post with the prize game and that they are familiar with and agree with the rules of the prize game. By participating in the prize draw, the participant is considered to agree to all conditions and rules related to the prize draw.

The organizer is not responsible for lost, incomplete, or incorrectly sent data or shipments.

Legal entities cannot participate in the prize draw.

4. Manner of cooperation
To participate in the prize draw, the participant must follow the Instagram / Facebook / TikTok profile of Ball Back System, and during the prize draw, post a comment below the post with the prize draw on Instagram or Facebook profile. Participants can post their comments under the prize post several times – participation is not limited to one comment per person.

5. Selection of the winner and prize
The organizer will take into account in the draw all participants who will meet the conditions specified in Articles no. 3 and 4.

The winner of the Ball Back System will be drawn by the organizer on May 1, 2022. The winner will be announced on the Instagram profile of Ball Back System and the Facebook profile of Ball Back System.

The draw will be performed by Urh Krajnc, the announcer of the prize announcement. The selection of the winner will take place in the presence of a 3-member commission on the part of the organizer, the draw will not take place in public. Before the start of the draw, the head of the commission will inform everyone present about the purpose of the prize draw and the method of selecting the winner.

The Commission will also determine the validity of participants’ applications during the selection process. If it turns out that the selected participant is not validly participating in the prize game, the selection for the prize will be repeated until the selected participant meets the requirements of the prize game.

The responsible person of the organizer keeps a record of the draw, which contains information on the date, time, and place of the selection, the persons present, the course of the selection, and the selected winners. The minutes shall be signed by all members of the commission, made in one copy, and kept by the organizer.

The results of the selection are final and cannot be appealed.

Prizes are awarded by the organizer under the conditions set out in these rules.

Participants in the prize game are aware of the possibility of winning a prize, which may be subject to taxation under the Personal Income Tax Act. The advance payment for personal income tax for the prize is paid by the organizer, and the winners, as taxpayers for personal income tax (paragraph 2 of Article 35 of ZDavP-2), are obliged to submit detailed personal data to the organizer in writing. tax number). The organizer will send the winner a form via e-mail, which must be sent correctly to the organizer’s address, filled incorrectly, and originally signed, within 7 working days of receiving the form. Submission of the above information is a condition for accepting any prize with a value exceeding EUR 42 including VAT. If the originally signed form with the completed tax number of the winner is not sent in time, the prize will not be awarded. The winner covers all costs related to the receipt of the prize (travel expenses, etc.). The winners also agree and are aware that by receiving the award they can be ranked in a higher income tax bracket. In this case, they bear all the financial responsibility and consequences themselves. The prize will be handed over by the organizer to the individual winner no later than 60 days after the end of the prize draw.

6. Award notification and sending of prizes
The prize is not transferable to a third party. The prize cannot be exchanged for cash or any other prize, other goods, or services. The images on the promotional material are symbolic.

The organizer contacts the winner via the e-mail address info@bbs-tennis.com. The winner of the prize draw must respond to the e-mail within 5 days, otherwise, the prize will be forfeited. The organizer will strive to hand over the prize to the winner within 60 days of receiving all necessary information. The participant who received the prize is obliged to cooperate with the organizer to receive the prize. If any winner does not react by their obligations in this participation and this will prevent the timely award of the prize, the organizer does not take responsibility for this.

The organizer is not responsible for errors in the submitted personal data (eg if the wrong e-mail address is entered).

The organizer is not responsible for other technical problems and excludes the possibility of any compensation during participation in the prize draw. The organizer is not responsible for any technical errors or errors in data entry during the prize draw and other reasons beyond the control of the organizer.

The organizer reserves the right not to award the prize in cases already written, as well as in cases where:

the winner does not meet the conditions for receiving the prize;
there is a doubt about the identity or authenticity of the data;
the winner did not submit the correct personal data and tax number.

7. Announcement of winners
The winner allows the publication of his name, surname, and place of residence on the publications promoting this prize game, for which he will not demand any payment or compensation from the organizer.

8. Limitation of liability
The company Ball Back System d.o.o. is not responsible for any loss, damage or injury, regardless of the cause that may befall participants in this prize draw. However, none of what is stated in these rules excludes or limits the liability of Ball Back System d.o.o. for bodily injury or death resulting from the proven negligence of employees or representatives of Ball Back System d.o.o.

The company Ball Back System d.o.o. is not responsible for non-fulfillment of this offer if such non-fulfillment occurs due to force majeure circumstances, which represent an event (or events), due to which the implementation of this offer cannot or cannot be satisfactorily ensured and neither party is responsible.

Ball Back System d.o.o. reserves the right to cancel, supplement, and/or and/or change and change its terms and conditions at any time without any liability.

9. Protection of personal data
The organizer of the prize draw undertakes to use, store and protect the acquired personal data by the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 94/07 – official consolidated text) and other legislation in this field and to use them. exclusively to conduct the prize game and analyze its course. Acquired personal data will be kept by the organizer of the prize game until the expiry of the legal retention period.

By accepting these conditions for participation in the prize draw, the participant is informed that:

• the obtained personal data will be processed until the purpose for which they were provided is fulfilled, or until the participant requests revocation (withdrawal), or until he notifies the request for deletion of data. Consent to the processing of obtained data may be revoked by the participant at any time by submitting a written request to Ball Back System d.o.o., Rabelčja vas 43, 2250 Ptuj or by e-mail info@bbs-tennis.com. In this case, the revocation of the consent does not affect the legality of the processing carried out based on it until its revocation. In the event of cancellation before the realization of the purpose for which the data were provided, the participant is no longer entitled to participate in the prize draw;
• by law, he has the right to request from the company access to data, their correction, deletion, or restriction of processing, and the right to file an objection against the processing of personal data and a request for the transfer of personal data. He can exercise these rights with a request sent to Ball Back System d.o.o., Rabelčja vas 43, 2250 Ptuj;
• can contact the organizer of the prize game, the person authorized for personal data protection, via the e-mail address: info@bbs-tennis.com;
• may file a complaint with the supervisory body (Information Commissioner of the Republic of Slovenia) if it considers that the processing of personal data does not comply with regulations;
• personal data obtained within the purpose for which they were provided may also be processed by contractual partners with whom the organizer of the prize game has concluded contracts on the processing of personal data and who can also ensure an appropriate appropriately high level of personal data protection;
• personal data will not be passed on to third parties except those users who would have a basis for this in law, contract,or another legal basis;
• there may be automated decision-making, including profiling, regarding the processing of transmitted personal data.

10. Additional information and complaints
The organizer or other persons participating in the prize game are not responsible for any damage that may occur as a result of receiving or using the prize or that would originate from the prizes, with which the participants expressly agree. The organizer is also not responsible for any damage suffered by the participant due to logistical obstacles, technical problems, or other errors.

In case of circumstances beyond the control of the organizer (force majeure), the organizer may cancel the prize draw. The organizer must inform the participants via the website: https://www.bbs-tennis.com/. In such a case, the organizer is not liable to the participants for the damage. The organizer reserves the right to change the rules if required by technical or commercial reasons or reasons on the part of the public. The organizer will inform the participants about all changes and novelties of the prize game on the website https://www.bbs-tennis.com/.

The decision of the organizer on all issues related to the prize game or. the application of these rules is final and applies to all participants.

The organizer of the prize game is not responsible for any damage caused by problems with the operation of the post office, loss of shipments, incorrect or illegible contact information or. any other technical problems that may lead to errors in the conduct of the prize draw.

Any errors in the work and implementation of the prize draw will be resolved by the commission in a timely manner promptly and in accordance with good business practices. In the event of a serious violation of the rules of this prize draw, the commission may cancel part or all of the prize draw and repeat it with appropriate corrections.

The organizer has the right to withdraw, change or amend the rules of participation in the prize campaign that he creates.
